THE hearing of a GBP 130 million "misrepresentation" lawsuit over the sale of Sir Fraser Morrison's Edinburgh-based construction business to the AWG utilities group was postponed at the 11th hour yesterday because it was claimed the judge assigned to hear the case was a friend of one of the principal witnesses.

Three Court of Appeal judges ruled that Mr Justice Evans-Lombe, who was due to begin hearing the action at the High Court in London today, should have "recused" himself and handed over to another judge.
